There are supposedly some contractors coming on in a SOW through an agency . Shambles BT let so many good contractors go yet keep the under delivering / over charging Deloitte and some contractors doing not much on fat day rates bluffing the Transformation Director

Below is a timeline of events: • All determinations carried out using CEST by line manager. • Assessment based on role and how BT want contractors to work (like employees) not actually on previous and existing working practices. • Inside SDS supplied not including any individual practices or information • Strong evidence supplied to official dispute process • HR team feedback... same party line, inside SDS upheld • New contract offered via umbrella, contractor has to pay 13.8% employers NI from existing day rate. (Elephant in the room) • Contractor decides to leave • Projects delayed, Product Owner frustrated and annoyed.

Still nothing from either Vodafone or agency. When asked, the response is "nothing has been heard or we don't know". To date, no assessments have taken place or none which the contractors have been aware of or involved with. No sign of any SDS either. No one is sure what will happen come end of the month. This is all happening while projects are being offshored to India.

BT is verbally providing (v late) confirmation that roles have been assessed and it looks like all contractors on this programme are being found inside. Experis had asked all clients to provide an SDS to their contractors by 15 Jan to allow 45 days for appeals, however most contractors have contracts that end on 28 Feb and are only just having their discussions now. No SDS have yet been provided or information about how to appeal - unclear currently who did the assessment or what it was based upon. I believe it to be flawed, based on the verbal commentary given to me - commentary was role based. It was also stated that BT cannot afford for contractors to be working outside IR35, in case they have to pay the tax later - which sounds like a blanket decision. At least one contractor has been also told they're liable for back tax and will be lucky to find other roles (client v far off script here - absolutely none of their business). Various programme go-lives will be impacted, although the client currently seems unconcerned (apparently they're just the messenger on the ground). Many contractors terminated last week - atmosphere is pretty down.

With exception of a few roles, all recruitment now offshore by default through VOIS locations in Romania, India and Egypt. Some contractors and agencies still in the dark over IR35 changes but writing on the wall with push to offshore work as quickly as possible whilst contractors are being rolled off. Expect an exodus come April 2021.

Due to the reform, Vodafone have confirmed that from 6 April 2021 they will no longer engage with individuals providing their services via Personal Services Companies; Vodafone will only engage with PAYE or Umbrella workers. Very difficult decision to be made by any interim headcount, given the current contract market & impact of covid within the professional services arena.......

Pontoon recently ammended contracts to make them 'IR35 friendly' however BT have decided already that Project Managers are all inside from 1st March 2021 regardless. Their statement 'From the 1st March the role that you will be performing has been assessed as in line with the HMRC CEST tool and is determined to be inside the scope of IR35’.

Division: Making Finance Brilliant SAP Program
Been on the MFB program since May, was offered an extension only to end of Feb. BT have issued extensions to most of the other contractors to the same effect . BT going inside is the talk from senior leadership . Time will tell. Time to move to another SAP program come Feb. Deloitte clueless at design and delivering, so many junior Deloitte staff and average managers bloating up the statement of work. Deloitte will absorb all contractors and deliver a MVP , Shame it’s not a NBA MVP but a thin ERP that will need re-engineering once again.

Final decision that all contractors from January 1st 2021 will be permie or umbrella. No SDS and ‘a more standardised model’ given as the reason. As a contractor I’ve not renewed and others have done the same. Merger with VM is driving cost cutting and the atmosphere is terrible with seasoned permies leaving as well. Lovely building from the outside but who is running the asylum?
