they had really onerous indemnity clauses both to my ltd and to me personally and forced the purchase of kingsbridge insurance. read everything carefully and make your own choice.

Capita are not engaging contractors via Limited Companies with a blanket ban, no assessment, not offering PAYE, and are quoting an all in rate that includes Employer NI, and forcing use of umbrellas of their selection via a PSL. I found another contract outside IR35 and left mid contract, which I’ve never done before but a lack of business partnership goes both ways.

Agent advertised the role as Inside IR35, then when client made me an offer, said there was a PSC ban in place, the client will only engage via Umbrella. No SDS as not required when engagement is via Umbrella. Recruitment consultant could not answer the simple question of who in the supply chain will be paying the Employer NIC's and Apprentice Levy. When I pointed out that the Umbrella would be my employer, and therefore they can only deduct employee NICs and PAYE Tax, I again asked would the end client, the agency or Umbrella pay the NIC's - pretty much stunned silence. Requested a Key Information document from the agency, again - tried fobbing my off. Freshfields, as a law company, are probably blissfully unaware of just how poor their engaged agency are acting - and thus will be loosing talented candidates. Honestly, what are Freshfields gaining by paying an agency and forcing the contractor to use a brolly? No value whatsoever. Really don't understand why they don't just put the hired candidate on their own payroll, and just advertise directly.

SQ computer personel havent paid invoices to many contractors who have provided IT services on their behalf to clients. And the dishonest directors have now filed for liquidation leaving no prospect of getting invoices paid. This is the risk we contractors have to put up with. I personally havent been paid over 10k worth of invoices pending since last year, feeling very sad..

Forced to use an umbrella from FCSA list only. No negotiations, worse still no assessment of in or out of ir35 even when I asked for one. Not happy, but I don't leave clients I have a great reputation. I am disappointed last year they said I was outside ir35 and now turned it on its head with a blanket ban. Its fair enough they increased my rate however they then forced me through an fcsa approved umbrella which have had alot of bad press.

I have seen an internal email from the “Risk” team telling all hiring managers that the firm wants contractors to be Supervised, Directed and Controlled. The email then goes on to say, therefore, everyone is inside IR35. I have also seen the “questionnaire” hiring managers were asked to fill, a very poor misleading version of CEST tool. And based on above point you are automatically have SDC applied. Hey presto you are inside IR I heard they will use Linklaters as a 2nd or final opinion. But this is all a farce as in the background the hiring managers are told the firm doesn’t want to take the risk of outside IR35 contracts. I was given a very weak determination, I had a great appeal, but when I spoke to the IR35 review team they said 0.01% of contractors are outside. KPMG are pretending to be fair, but in moving the goalposts to suit them.
