My Short-term contract was originally only available Inside IR35 through an Umbrella Company. As soon as it was announced by the Treasury that the roll-out of IR35 in the Private Sector was to be delayed by a year to 6th April, 2020 due to COVID-19, I was allowed to utilise my Limited Company (PSC) for the duration of the contract.

Unfair IR35 assessment
Questionnaire completed by someone who openly admitted they were not qualified to answer the questions on the cest assessment. They are trying to do the right thing but education required and the recruitment agency are stepping back as they don’t want to be seen to coerce I feel deflated as there’s no way the role is within ir35. Having to fight it with a customer that agrees with me, it’s outside, and it’s going to cost us both additional unnecessary money to do this!

Company using Qdos status review tool which is easy enough to complete and provides an SDS. There hasn’t been much impact in IT as there are very few contractors overall - the process has taken a longer time than I am used to though (nearly 5 weeks from initial conversation to start date) which may have an impact in future. My agency, Sullivan and Stanley, have been great at advising and supporting both me and my end client contact. They have a solid and proactive approach to IR35. I’m feeling relieved and grateful that I have a gig that should see me over the turbulent bedding in time with a client who is approaching IR35 sensibly and fairly, and that I work with an agency that’s on the front foot.

Blanket ban and not carrying out Determinations. Project people colluding with their other major client that is offering outside ir35 to prevent mass exodus so they don’t lose contractors on their books. No one has accepted umbrella option to date

Initially it looked like they intended to carry out genuine assessments (they created a tool we were filling out etc). Then they ignored the results and told to us (IT systems BAs and developers) that we will be all individually detrmined inside ir35. In the end they offered to all of us 12-month FTCs
