Sham of a process. No reasons given for initial determination or following failed appeal. No discussion or assessment of actual working practices and ignored contractual obligations. extremely poor. In effect a decrease in rates as employers NIC and apprenticeship levy being deducted from agreed outside rates. Extremely demoralized. Contractors leaving.

Unfair IR35 assessment
Same SDS issued to all U.K. contractors despite varying contracts and working practices. Information (answers to CEST) in the SDS was patently false compared to the engagement with my company. Clear lack of reasonable care. My appeal was rejected, it included: - Evidence their original SDS contained false information and could only have been arrived at with a reasonable lack of care - 3rd parties assessment of working practices (outside) - evidence of lack of SDC and direct comparisons with case law Their response to the appeal included no further reasoning or justification. So the only SDS is the original one with false information. Interestingly, I know they contacted the hirer within the company as part of the appeal, who the work is being delivered for. They were asked to do CEST and it was outside. Yet still UCB returned an inside determination with no rationale beyond the original SDS. So somehow UCB ir35 team know the situation better than those close to the engagement. Completely contrived determination to suit their agenda.

I terminated my contact with GSK because they asked me to breach RI35 rules, I never worked the notice period, I informed them of the breach and left. My company was approached by GSK to provide services, the terms of my contract were negotiated direct yet due to GSK’s ways of working, I was pushed to work through Lorien. Lorien always assured our company that the contracts were RI35 compliant and they had engaged with QDOS to assess them, yet when I pointed out requests to breach RI35 Lorien didn’t offer any advice, they simply said it wasn’t their problem. So I decided to terminate the contract. Lorien didn’t care GSK didn’t care They simply found a replacement person willing to bow down to their bullying tactics.

Blanket ban on all contractors sitewide commencing 01 Mar 2021. No formal communication from Site Leadership or Senior Management, causing a great deal of confusion - as this was a sudden and unexpected reversal from company strategy in Mar 2020, where contractors were evaluated according to CEST and many were found outside IR35. This has coincided with a large increase in the hiring of Commonwealth PAYE workers, who are rather contractually excluded from overtime The impact on project delivery and shutdown is expected to be severe.

All contracts deemed inside IR35 (no evidence they've done the due diligence), only offering PAYE/Umbrella on 18 month contracts on a criminally low rate. Feedback from Agency: client are blanket assessing prior to April next year as they are risk-aversive and can't be bothered with the level of administration for determining roles Outside IR35. Safe to say, I turned down the interview. You want monkeys, PAYE peanuts!

Unfair IR35 assessment
A communication went out saying Vertex are proceeding with “implementation of the new rules” despite the government roll back- not sure what that means given liability for tax remains with the PSC. Agency contractors all put in to ir35 / contracts. Direct contractors some are outside some seem to be under pressure to go onto FTC which is what they are attempting to implement (it is presumed). Suspect they want to be contractor free by April 2021- hopefully by then the rules will be ditched in their current form. Lots of confusion.

Unlawful CEST based blanket assessments from Dec 2019 stand, though working through PSC now allowed again, risk continues to be pushed down to the contractor by a lazy unethical HR dept. All new engagements unlawfully assessed inside IR35. It's clear the lesson hasn't been learned and Seqirus is still a contractor kicking shop.
