Before joining I was told by Human Remains I would have to go PAYE “due to the new IR35 rules” fair enough I thought, that’s the way the world is nowadays. I joined to find the majority of contractors already there were enjoying being outside IR35 and others who joined after me got to be outside too, HR didn’t care when I complained so I left when the first decent alternative came along :)

Worley SCAMMING Contractors with their new PAYE contracts.

Contract rate reduced by 25% to new PAYE rate presumably to cover Employers NI and Holiday Pay. WRONG was I. The holiday pay received only accounted for 6.5% of the reduction. With Employers NI accounting for around 13% I asked where the rest of the money had gone. When I asked for a breakdown of how the PAYE is determined I was advised they would not provide that information. I was PAYE for 2 months before leaving this bunch of charlatans, and received £1200 less in holiday pay than I should have. That's equivalent to £7200 per year. Worley, and Energy Resourcing are at it, big time, good luck to anyone desperate enough to work for them. Worley have been scamming money from Contractors for years now whilst charge out rates have remained the same. Skinning Contractors rates to pay for useless entities such as People Consultants - wtf are they?

Worley contractors told to accept PAYE or leave

Worley contractors have been told to accept a new PAYE contract or leave. In fire/rehire scenes reminiscent of P&O, contractors are handed a termination contract on a Friday afternoon along with a rehire contract with an average rate reduction around 25%. This follows on from last year where Worley engaged a third party to determine contractors IR35 status. Contractors were accountable for paying for this determination. As you can imagine, morale among contractors has hit rock bottom and they are struggling to get any new talent to accept the low rates they are offering. All contractors are now actively looking for roles outside of the organisation. Worley will quickly find they lose all of their talent and end up with the people other organisations are not interested in.

AVOID LIKE THE PLAGUE. Worley are now taking a blanket approach in order to remove PSC from their business, your only option will be staff or PAYE, with the rate reduced to pay for THEIR employee NI contributions. Over 600 people in the UK are set to be effected and by June all of them will be given the option to leave the business or accept a vastly reduced PAYE rate. They are completely unable to recruit any position now due to their PAYE rates, if they offer you PSC be aware that come June at the latest you will be caught up in this. Not that they'll mind, their plan all along has been to run down their UK business and fill voids with their Indian engineering centres.

Permie only (shit salaries) unless you're one of the well connected old boys. and/or good mates with the senior pm. A few of these guys have been added to the approved supplier list and allowed to stay Ltd, and a few others have been passed to an external consultancy who have magically assessed them as outside IR35 (even though Cadent previously classed them as Inside).

Assessment Tool use CEST They made a decision without my precence. The two people who made the decisions and Contractors of Ørsted (who of course will never be deemed inside IR35) The determination should have been made by a 3rd party. I feel sad, depressed and disheartened. They’ve given me more work to do. Contractors are leaving, work ethic has changed, atmosphere is awful, people are feeling betrayed. We work genuinely long hours but if a staff member was to do the hours we do, they’d get over time and a pat on the back!

Poor execution of a blanket ban, all last minute. Terrible PAYE offerers with most rates slashed. Mob fee insufficient and no offer of hotels or paid courses. Bottom line is there rates do not represent the job required.

Been told deemed inside IR35, currently on another project for a different company covering the same role and I'm outside IR35. New project inside IR35 wanting me to supply my own laptop pay for travel, hotel etc. To place of work other than the site address stated in contract and then claim expenses back at later date. The project itself is 28days on/off from May-Nov but the days are calculated as 5 days a week over 12 months so take home is a lot less. How this falls inside IR35 is beyond me.

A true ‘head in sand’ approach or was it...... A place known in town for paying the lowest rates and for poor treatment of its staff/contractors waited until the true 11th hour before unleashing new contracts, possibly to give people no choice. The new ‘IR35 friendly’ contracts are aggressive in terms of financial risk/cost recovery and a stealth paycut, further reducing poor rates. Twenty five people have voted with their feet already. This has turned the misery of IR35 into a profit for themselves.

Grossly mismanaged process. Assessment forms sent out only a couple of weeks before April 5th deadline. Company has introduced punitive contract terms under the guise of proving ir35 compliance. Company is forcing non-resident contractors to adopt new contracts when they do not apply.

Deeply flawed process in 2020 with appeals ignored. In 2021 Shell UK decided to work only with agency PAYE “contingent workers”. Employers NI, pension contributions and holiday accruals deducted from previous Ltd Co. Rates. The good and real contractors are gone or are going - leaving the monkeys to collect the peanuts.

Blanket banned LTD, No umbrella's, No appeal process. Technicians have been handed PAYE contract days before end of march, all techs are expected to sign new contract with poor rates of pay and CAN offshore have slashed mob fee. Every LTD tech are being forced into a contract they do not agree with, starting 1st April. Many techs are refusing to sign new PAYE contracts and wanting to leave platforms and techs are even refusing to go offshore. CAN Offshore HR / IR35 Team are not answering appeal emails. No support from CAN Offshore, lack of care for mental health.
