Assessment done by Urenco & EY with detailed input and questionnaire by me. EY provided a report to me with a score showing my role was outside. Further review actually lowered the score, moving the role to even more securely “out”. EY and Urenco happy to have feedback and review their assessment. Morson were not involved on the process at all. Very impressed, wish more clients were like this.

Sellafield Ltd. live up to their bullying and harassing reputation publicised in the national press last week www. bbc. co. uk/news/uk-56011909, by forcing unfair blanket determinations on contractors. Whole business units determined in scope of IR35, reasonable care clearly not taken, utter disregard of the law and contempt for workers. Contractors leaving safety critical jobs by the day. Fed up of being abused and harassed by Sellafield, morale at site at all time low. Shameful.

told to pay 50% fee for 3rd party SDS or automatically inside IR35. Transferring assessment responsibility from Client. Responsible role for safety of work force. Discriminatory legislation and highly biased against legitimate companies. Reintroduction of slave labour.

Agency advised most have been put outside IR35, however some have been ruled inside even within same department, indicating it's been done on an individual basis. Company is generally trying to reduce contractors, but that's more a business strategy decision than IR35 as far as I can tell.

Similarly to last year, Cavendish have selected CEST responses to guarantee an inside IR35 determination. No recognition of working practices or consultation before or during the assessment. Cavendish's acknowledge to a challenge states that they won't even review the challenge until after 6th April. A blanket ban in all but name and a message to contractors to take it or leave it.

Blanket ban! HR have manipulated CEST answers to ensure all roles are deemed inside IR35 and over turned line managers CEST assessments. Appeals take 45 days and the process will not begin until 6th April 2021. Notices submitted on mass

It has been communicated that Cavendish Nuclear are preparing to shove all of their contractors on mass in scope AGAIN. The 12 month postponement was merely a delay to the inevitable. As expected, unfair assessments, frigged/incorrect answers to CEST determination questions to push you inside, no appeal process. Unfair & unprofessional. I hope all PSCs take note and get themselves fixed up elsewhere like I have. I predict a future struggle to attract resource to Cavendish Nuclear, and knock on project delivery difficulties - all of their own making!

I was not advised of what assessment tool was employed and have not seen evidence of the assessment over and above the letter that was issued. I appealed and received a swift rejection. It basically agreed that the current contract is outside but beyond April 6th the contract that will be employed will be inside of determination due to changes that will be imposed. complete white wash. No evidence of individual assessment, confirmation that the end user "their words" has made a role based assessments which have been cascaded down. projects are being impacted, contractors are leaving where they can and where not are being forced into umbrella engagements. atmosphere is very poor/low. Feeling like a victim of a great injustice.

Although we have a very strong contract, assessed by Qdos everyone from what I've seen, has received a blanket determination of 'inside'. They stated that everyone has been individually assessed even though the determination document had no worker's names or company's name attached. Several of the lads even had the same reference number on the letter! Have sent my appeal in but don't hold out any hope. Umbrella is inevitable it seems.

CEST Assessments are flawed as managers manipulated the answers to provide an inside determination (as instructed) and have said they will not accept any challenges ( just got mine back and I’m still inside, surprise, surprise), 100% blanket assessment. The project I am on is being impacted now as contractors are already leaving/retiring early. I am feeling very let down and I will be leaving ASAP.

Client is a PSBO and uses Role based CEST assessments, with predetermined outcomes. Proforma letter with individual name giving employment status provided on request. Hard to say if contractors are actively leaving, or being let go as part of a continuous 'role reduction process' which has significantly reduced contractor numbers. With most contractors seemingly over 50, many are considering early retirement. The general feeling is one of uncertainty and disproportionate unfairness that Labours' IR35 should even exist, let alone be made worse by the Cons. I feel resigned to suffer being trapped in this zero rights - high tax situation for a few years and retire.

Managers assessing roles have been given guidance on how to answer each question of the CEST tool in order to produce an inside result, regardless of the working practices, and there is very little hope in appeals.

I was advised that SDS would be issued in January and still nothing. In the interim time that has passed i have not been contacted once to ask me any specific questions about delivery of my role and engagement and I fail to see how a fair assessment can be arrived at without this when i have very little direct contact with anyone from the client and no supervision at all. The entire situation is very unnerving with no indication of what the outcome will be, what I may need to do or any arrangements that i may need to make once a SDS is returned. Details like if captured inside what will be the engagement route, how expenses will be handled, if umbrella companies are to be used?????? All questions and no answers......
