It appears that exceptions have been made for some contractors to be outside IR35, when the official comms is that there is a blanket inside ir35 verdict. naturally these are friends of senior management, these contractors also have line management responsibilities, do appraisals and so on so the determination is questionable. cronyism.

CEST used and individual assessment provided although not accurate. Contractors either joined as perm or forced to choose between PAYE/Umbrella Confusion, ignorance, lack of awareness. Contradictory information from recruitment agency, HR and Managers. Feeling trapped into accepting something I don't want to accept.

HMRC assement tool used, Given an SDS. Unaware if this covers all projects with all freelancers or if it's selective based on who they're hiring. (A senior might be given more flexibility on being in or out of IR35 than a midweight worker). They seem happy to discuss this through emails.

Blanket decision across the whole ITV to go inside. No consideration for individual circumstances. And IR35 does not even apply to me, as I'm not a UK resident! I chased the assessment team for a while, but they simply ignored me. It's a shame to be leaving generally a good place to work.

Role based assessments carried out with no review of actual working practices. Lower rate on offer "to offset the additional tax and national insurance costs incurred by Sky". No discussion and no flexibility. Several key contractors now leaving team. This will have a major impact to project deliverables.

As already mentioned by others - NewsUK have banned PSC engagements (save for a few friends of the Exec perhaps), but in general every known worker in Tech has been asked to go Umbrella only. (it would be interesting to know if treatment has been the same with other talent/celeb type contractors outside tech, in the Title teams) The client I understand has done a U-Turn since last year when Offpayroll rules were meant to come into effect where several people were deemed Outside with an SDS. Client are now in negotiations with contractors to try and retain them, but it's clear that some are getting good deals while others are getting next to nothing - several programmes are now either in jeopardy or stalled completely. Large groups of contractors have left including at least one permie manager who fought hard to keep the team from leaving. To make things worse, NewsUK are also overhauling their tech resourcing PSL with a view to prioritising the recruitment of offshore workers to replace or supplement UK contractors - apparently this is easier than simply complying with the regs and doing proper assessments and/or getting insurance. Covid has taught NewsUK that you could be anywhere and still do a good job - and if the worker costs less AND there are no IR35 issues, double bonus! Many contractors are doubting the lawyer that NewsUK used to consult with to get to this point, as well as deloitte's involvement as everything seemed so rosy and congenial a year ago. This is a massive shame, a complete own goal. It goes to show how government policy can totally reorient decision making processes nationwide, and negatively disrupt the market for what is basically, the expertise behind several innovations in this country and abroad - but you won't read an analysis of this kind in The Times, will you?

Sky have blanket inside IR35 AND lowered the rate on offer. Contract has clearly not been properly assessed. They seem to have very little knowledge on good practice regarding IR35. Was hoping that a year later they would learn from their mistakes. Will be leaving for a better rate/contract.

EY helped with assessments and they were flawed. No proper SDS were provided it was a blanket ban which is now deemed illegal by HRMC.

We have been informed that PSC Inside IR35 engagements are banned (useful for those who prefer to keep the PSC running to pay pensions etc). We're being forced to use umbrellas so that IR35 simply won't apply.

After being assured for the past year+ that my SDS (not received) would retain my outside IR35 status I was shocked to hear yesterday that all Technology contractors will be deemed inside from April. During the last meeting of "out" contractors in November (approximately 40 present) we were all assured that the right of substitution would be retained, etc. To have this complete change forced on us now seems extremely unfair. Although I have a project with 6+ months left to run I am seriously considering my options, as I am sure are others.

email has ben sent to contractors saying that NewsUK will not accept substitutes and will exercise control over contractors - hence taking outside ir35 engagements off the table altogether. that does cast doubts on the contract they have knowingly signed to date though!

Today it's been announced that everyone in tech (save for exceptional cases which no one knows of) will be deemed Inside IR35. I understand that this also includes contractors who were deemed Outside last year before the regs were delayed. This time around Deloitte are involved, therefore there's a likely conflict of interest, or the risk appetite has changed - either way there has been no concrete reasoning for the blanket determination and SDS are not yet available. The feeling at the moment is that the appeals process will not be successful and everyone will have to use an umbrella company. Several projects are impacted, but the upside is that there is now an incredible talent pool for more savvy companies to hoover up, so please scour LinkedIn for Tech contractors and offer them something decent.

Rates reduced due to CV19

Blanket contract rate reduction between 10-15% back in May last year - supposedly only for a few months but has carried on until the present moment, however no culling to my knowledge but i cant be sure as we've all been working remotely. it will be interesting to see if this changes with ir35 determinations due any day now.
