Despite being advised before the contarct that MatchTech would do "everything they could do" to provide an outside IR35 SDS when the time came, in relaity contractors were faced with NATS HR team (who I feel don't understand IR35) and MatcTech who were happy to help push any of their contarctors inside - so that they could retain their cosy relationship with the Client. Sadly, after 9 months supporting an important project I choose to walk away. Felt very 'blanket ban-ish'.

IR35 Blanket Coverage, SCS claimed they have done a fair assessment using the HMRC CEST tool. They sent a copy of what they filled in, their answers to the CEST questions looked pre-determined and not related to what I actually do to make myself fall inside IR35. They offered a chance of an appeal without providing what evidence they were looking for. This leads to a conclusion they knowingly and willingly falsified their answers to place me inside IR35. One of SCS Railways's core values is Act with integrity and respect - what a joke! PSCs are now banned. No real meaningful uplift to counter ir35 given. Contractors are leaving and looking for other work. Team morale has plummeted

The cest tool was used, I did a self assessment based on my companys operation, and I was deemed outside based on how I conduct the role. An individual assessment wasn’t made it was a blanket approach based on the DAC role, it was based on the “role”. There are contractors leaving, Our appeal got rejected without explaining why our appeal was rejected. The atmosphere is stressful I am counting every hour getting close to leaving because I don’t know what other strategic plans scs railways have in place to cut our pay even more. I feel stressed and under pressure, everynignt im thinking about it especially now that I have had my second child and a mortgage to pay with these cuts I won’t be saving up for their future but rather working to live. Please help us get back to outside of IR35

They used HMRC assesment tool but use wrong answers that fit their purpose of putting everyone inside IR35. The individual assesment was not done but the position was assessed based on the company considerations. They are offering a Fixed term contract but all contractors are very unhappy on how the situation has been managed.

SDS received today and outside IR35. The company used IR35 shield and the HR team at Boskalis did a great job with very good communication with myself throughout the whole process. This was a breath of fresh air compared to my previous contract with an oil major who couldn’t be bothered and had a blanket approach with all being inside and having to go PAYE/Umbrella

Fudged IR35 assessment with answers locked by DHL result was a forgone conclusion. Using IR35 Sheild the determination could only go one way. Not a surprise really as I had been told all roles would be inside some days prior to the assessment. No mention of any appeal and day rate is being reduced to account for employers NI. They are giving notice on current contracts and will re-engage on another at a lower rate.

No 1-2-1’s, no SDS just told your inside with no means to discuss or appeal and given notice, others in the same role but on higher profile projects deemed outside and having new contracts written to protect the projects. No idea if the did use a tool as no one was walked through the process. Yodel is losing millions and is up for sale, IR35 seems to be a vehicle to reduce headcount and spent. Also, zero contact from Rullion throughout the whole process.

Yup confirmed. No individual assessments at all. Just told to go elsewhere. Suppose I'll start looking for a normal job and fight for one that 1000's of other drivers in the same position will be going for. Cheers Government, what next? A corona tax? Air tax? Thinking tax? Paying tax tax? Shocking behaviour and terrible treatment of contractors that have provided a flexible work force for years.

I've been working out of IR35 and reinvesting money into another side startup (and paying 20% tax on it) with the hopes of taking on an employee this year. Now, this side startup has essentially had it's funding pulled from it, and all of my hard work has been for nothing. I have to close down my business and I'm out of pocket by 10,000's now. All of that hard work for absolutely nothing. If I rely on the startup to generate it's own revenue, it'll take 30-40 years to make enough money just to break even. I needed this arrangement to grow the business., now it'll stagnate. I put off getting myself on the property ladder to get my business started. I've worked long shifts and paid massive amounts of tax and now it seems it was all for nothing. How is this meant to help the UK economy? I was generating VAT and corporation tax through this start up and now in a *poof* it's gone. I'm sick of this Government trying to money grab. IR35 is going to decimate a transport industry which already has a driver shortage of over 40,000. The UK needs to prepare itself for no fuel at the pumps and no fuel on the shelves. As for me, I can't afford to buy out my own company with my personal money to make it tax neutral now. I'm now going to have to stop trading at the end of the tax year, use my own money to pay HMRC and then have stock stuck in my attic until it rots. If I sell it, I will need an accountant and have to pay VAT + Corporation tax and I can't afford that. We've all been blanket banned, no individual assessments and if I'm honest, if IR35 comes in, I can't see the point in living to just be in debt to HMRC, or work for minimum wage driving a HGV. I probably won't be alive by the end of the year.

They were given copies of original contract between myself and SCC which clearly stated MOO and Right To Substitute, given copy of CEST which was answered honestly and gave result Outside IR35 but fudged their response to ensure Inside IR35 Determination. Clearly playing it safe and in doing so have caused themselves issues that will delay projects due to contractors leaving. Atmosphere remains good as we are all very professional but all non-HR staff are disappointed to have to find new resource. I am frustrated as I went through the same issue in the Public sector - clearly the system is designed to produce incorrect determinations by scaring very conservative organisations into playing it safe.

Poor comms and lack of clear data from the Agent, told all was being done to clearly assess IR35, poorly assessed by anti-contractor managers. Assured that rates won’t change but assignment rate post April will be down 15% to cover Employers NIC, App levy, pension....savvy contractors are noticing, not all. Total disregard to discuss and split costs if needed. Will lose a lot of contractors.
