Been told today that all roles have already been assessed as inside and employers NI is being deducted from the agreed rate - even got a worked example. This is despite me having employed staff and supplying into them (via 3rd party). Con call arrange for end of week to discuss. But long and short is all work to go via a frame work provider and you like it or leave.
Thorough assessment involving staff specifically trained in IR35 Chapter 10, SDS recieved.
Mood is cautiously optimistic as no contractors have left as yet.
Individual assessments done via Paystream almost two months ago for Contractors on Crossrail Project, still not had final decision. Now mid March and causing much stress/anxiety being uncertain what will happen in now only a couple of weeks. Many spoken too in same position are looking at moving on at critical stage of project. Very poor communication with Contractors to date.
Everyone is being ruled Inside IR35. You can then appeal with a QDOS assessment that you have to pay £79 for. Amey management then judge if you've answered the assessment correctly and ultimately rule you in or out of IR35

They have come up with 6 questions which are impossible to pass and therefore everyone is inside no matter what!!

Hitachi has imposed a blanket statement on no use of PSC's with the only options being under the agency as PAYE employees or permanent/fixed term contracts with Hitachi themselves. Obviously this causes a considerable undue amount of stress to all contractors invovled and their families as only limited number of permanent positions exist with substantial numbers having their engagements terminated on 27th March 2020
