Outside IR35 contractor on a an outside contract for two years. Day before I was due to leave telent they said I could not work at Telent without working through a company called telecom people. They kept going on about me being part of their company and how great they were. I'd never heard of them. Attended an interview with them. They dismissed a lot of my comments and disregarded my concerns. They changed my payment schedule from weekly to monthly. They wanted me to sign an associate agreement and a retainer letter. I asked them repeatedly for the SOW and when they sent it there was hardly anything in it. I raised my concerns but didn't have time to respond properly as my contract was finished. So I sent my equipment back and assumed my contract at telent was finished.

No discussion on determination. Inside or nowt. Though aware they are engaging foreign PSCs so not a complete ban. Employer NI deducted from agreed rate. Pointed out that this was not legal. They were unresponsive. Currently looking for other work.

Arup have used AMS for my assessment, however the process seemed flawed, as another person has also stated. The communication between Arup, AMS and my company was very disjoined and at times it seemed no one knew what stage my assessment was at. In my case, some of the questions in the CEST tool were answered incorrectly, which pushed me inside of IR35. Arup left the determinations to the last minute, early March, so I was not able to appeal in good time, however I found that wouldn’t have mattered because the appealing I did manage to do, Arup were not interested in considering a PSC outside of IR35. I have now left the company and am moving onto another role which has a PSC so I can continue my work outside IR35

A year ago, Arup used EY for IR35 status determinations. EY ruled me outside IR35, which agreed with independent assessments I had previously paid for. Arup are now using AMS as an agency for off-payroll workers, and relying on the AMS SDS, which seemed flawed from the start and has declared me and many others inside IR35. They use the CEST tool, and entered answers which disagreed with those given to them by my hiring manager. The appeal process is pointless. At best they are acting in a hyper-conservative manner, at worst, AMS are deliberately dishonest. I've agreed in principle to accept a new contract under IR35 and to work via an umbrella, but I may yet change my mind and refuse it, given the possibility that it may suggest to HMRC that I was inside IR35 on previous engagements with the same client (I don't believe I was). I've always done my due diligence and had any proposed client engagement IR35 assessed before agreeing to it. I've deliberately avoided any work that could reasonably be considered inside IR35. This feels feels unfair.

No individual assessment, no time to loose with contractors Just a letter confirming inside IR35 Pointless appeals To make it fair proposal of somehow a permanent position could be discussed inside a company hard time where redundancies are in place at that time Working there is just like numbers With this pandemic hard to find something The project will continue as if leavings I feel angry because the time and effort spent over there don't give you any positive return It's a waste of time to work over there as a contractor but also as staff No more shares since changed to a US holding I'm happy to be contractor as if I'm paid what I get Cheers

I received an individual assessment using the CEST tool to assess IR35 status during a meeting with HR and I was proven to be outside IR35. telent have now consulted their company tax advisor who has decided I am inside IR35 due to them not understanding their own contract and choosing to interpret the contract in a way that the contract does not support so that I am forced to go and work inside IR35 through Telecom People. I'm due to finish my contract at the end of the month. I will leave and take time to reflect if I can do business in this hostile environment, when companies are doing their best to mislead and force us inside IR35. The atmosphere is very negative and I'm really angry, but I shall remain professional.

Answers to the CEST tool questions have been answered to suit an inside determination. This is very frustrating so this Associate will be moving on come April. They are a great client to work for however, this has sadly soured the milk and made it impossible to continue supplying services to them.

It’s clear to say that all SDS are the same for every contractor indicating inside status! The company have no confidence in their abilities in making an outside decision as HMRC would potentially come knocking. Absolute diabolical state of affairs for the genuine consulting community and financially horrific. PAYE tax, additional Employers NI and pension payment nightmares. Not many options for the future if you persist with your Ltd except to leave the UK!!!

My engagement has been assessed as Inside IR35. Zero consultation with management which is frustrating, especially as we have been advised to challenge it but not to discuss anything with our local management. The assurance that HMRC are unlikely to consider any investigation if the current engagement rolls over without any change is very misleading. Associates seem to be keen to leave, even if that means an inside engagement elsewhere while they look for further engagements outside.
