Inside IR35 roles via umbrella or fixed term contracts only at current time despite some other Welsh health boards having outside IR35 engagements, which is disappointing, and stance has not changed since rebranding themselves recently as far as known.

Excellent engagement between client, agency (Xpertise) and myself. Individual, fair assessment carried out using Kingsbridge platform, yielding an 'Outside IR35' SDS result. Very contractor-positive atmosphere.

All contractors instructed to hand in their notice and they'd be offered PAYE/Umbrella roles. Some did this and have now been told they'll not be offered new contracts anyway. No real results from assessments have been supplied though the KPMG tool has supposedly been used. No input from contractors at all.

Role based determination - used gov CEST tool, for which they input their own answers. My answers differed quite considerably. Was finally told, due to my role I am seen as being inside IR35. Further that I would have to use an Umbrella Company if I wish to continue working with them past April 21. I don't entirely blame the client, businesses are already very busy and lack the necessary skills to make these determinations. I feel as though I am being punished by HMRC for working as a self employed contractor for many, many years. A way or working that I was very much encouraged to take by successive governments over many years. Be an entrepreneur, run your own business, help the economy grow, increase your earning potential, etc, etc... until such time as they decide you are actually doing ok for yourself and deserve to be put back in your place. Rant over... for now...

Individual assessments carried out in all contractors. I was found outside, which I agree with, and I will continue working in the same way I always have with them. Contracting/POs tweaked a bit. No drama.

Blanket ban on PSCs - a real lack of understanding of IR35, especially at the recruitment partner, Hays. Unlawfully deducting NI from the contractor yet claiming no-ones rate is being reduced.

Assessment supposedly carried by management using KPMG tool. No consultation with individual contractors or contract review. All contractors found inside IR35. Assessments carried out same time last year using PWC tool were found to be outside. Likely to have significant impact with contractors planning to leave in the middle of a major transformation programme.

By default all roles now inside IR35. Must use umbrella (no PAYE option unless agency prepared to administer this). No holiday pay, sick pay, special leave etc. Once all this taken into account contractors are worse off than perm. Rates about third lower than before IR35 & managers obsessed with getting cheapest contractors. Many scandals in NHS with data wrongly handled (eg track /trace etc). Most contractors now former supermarket shelf stackers or receptionists with poor IT skills but "cheap".

Role was assessed as Outside IR35 by 3rd party assessor and offered to contractor. After contract offer made Finance Dept intervened and said "CCG policy was for all roles to be inside IR35". Refused to budge on rate which was low and below market to begin with. Offer declined by the contractor. Contractor annoyed at being misled regarding blanket IR35 policy and would never have agreed to waste time on interview and all the endless admin due to low rate being offered.

Division: IT
Gov has postponed IR35 its now legislation however org only allowing contractor a 3 mth extension as PSC till end June. Why June? Why not Dec? If the Gov is helping why the org bending the rules what the benefit them? Why can't we just continue as is ie PSC until 6th April 2021? They will lose a lot of key individuals. Company used CEST tool and blanketed everyone as inside IR35 we weren't given a chance to discuss we were told and not asked. I was provided with an SDS the rate was dropped without a discussion. Projects will be impacted as lots of contractors will leave as lots of new roles are being advertised as Limited/Off Payroll. What was a great atmosphere is now demotivated and we're all in the same boat re COVID-19. I am annoyed with the organisations decision as they never provided justification re PSC till end June & umbrella after that. Totally unfair

Role confirmed as outside IR35 but rate reduced to net inside IR35 rate. No discussion or consultation. No response when queried. Roles now only offered to June and will then be reviewed.

Now they have changed their mind & did the deferral as per Govt IR35 postponement. Due all this they hv already decided to put the project in maintenance mode & to use its funding somewhere else by the end of April. It’s too little too late by Govt and hence many contractors will be out of work soon.

project continuity terrible as contractors leave on one weeks notice. Only thing HR can provide program managers is FTC which only attracts temps. Shame they can't form contracts for PSC any more to get their projects complete.
