Blanket assessing followed by PSC ban in 2024

Blanket approach to all contractors across the entire business this year. Illegal unethical and of course the good people will leave putting all their projects at risk….going back the way after they appeared to be fairly assessing individuals last year…moving on asap. I refuse to pay employers and employees NI, an apprenticeship levy as well as an umbrella fee out of my rate. Employee for tax purposes only? Get lost!

Pay slightly better rate than main banks for inside contracts but still no where near psc. No assessment took place. Contractors have left but new ones starting inside that are willing to work for low inside rates therefore encouraging the practice of not bothering to assess. Feel overworked and undervalued.

Get in line or leave, perm or PAYE only. Went PAYE. Date of previous ltd contract expiration approaching, told I'd be let go if didn't go perm as been there over x years... I thought with PAYE that wouldn't matter, but it did to them, some new policy. Perm offer too low. Left. Bad management of the whole process. They need to get some IR35 lawyers in place. No clue what they are doing. Critical project deliverables dropped due to mishandling of this.

Night and day to their approach last year with the blanket ban on PSC’s. This time a QDOS assessment, which I was happy to pay for in order for things to be done right. Questionnaire easy to complete, assessment given next day, Outside IR35. Sorted.

Flawed approach to IR35, they allow SOW based approach through some 3rd party companies who deliver nothing but just a dummy warming of the bench. They let go lots of genuine contracts in the name of blanket ban but bring contractors through their favourite companies via SOW.

Despite an aindividual assessment by two managers that I was outside due to working practices and an IR35 compliant contract, the central HR team took the easy option throughout Experian to put a blanket ban on PSCs. Pontoon just rolled over and went with it. Had no choice but to leave as I felt that the decision left me open to a restrospective tax liability.

The business have a blanket ban on PSC. The work offered is in a project, so most definitely could be classed as outside IR35. The business are using HMRCs CEST tool for assessments. No SDS provided. Forced into umberella if I want to take up the role. The agent are equally as incompetent, with the stance that you have to use one of the Umberella companies on their referred list. When quizzed about the illegal deduction of employers NIC and apprentoceship levy the response was they are all doing it. Diabolical all round!

No compensation / rate uplift for contractors now having to pick up the Employer’s NIC, apprenticeship levy and Umbrella company charges. They are resigned to using companies like TCS as a body shop. Needless to say I turned the role down.

CEST assessment completed by HR and hiring manager in isolation from the contractor and without review of the contract. Despite Contract terms and working practices allowing substitute, they have said no substitutes accepted. Engineered an inside IR35 outcome for ever contractor on the books. No communication until 16:30 the day before a bank holiday, then tried to push contractors into FTC or Inside IR35 through Umbarella. Disgusting organisation would never work with or for them again even if it was the only option on the table!

Shockingly unfair U-Turn at the final hour! After telling a number of contractors that they are outside IR35 laws and providing the CEST assessments to contractors confirming this. Admiral decided to do it again to sway the decision that was in their favour and placed all contractors inside IR35. Appalling.
