Unfair IR35 assessment
Division: Training
Received an email from QA. At no time has anyone from QA interacted with us to assess our individual status. "As your contractual terms with QA extend beyond 6 April 2020, we have completed an online HMRC Check Employment Status Test (CEST) assessment for your engagement and the Status Determination outcome from this assessment is that your role will fall inside of the IR35 Regulations"

Unfair IR35 assessment
Division: Training
I received an SDS this week. "As your contractual terms with QA extend beyond 6 April 2020, we have completed an online HMRC Check Employment Status Test (CEST) assessment for your engagement and the Status Determination outcome from this assessment is that your role will fall inside of the IR35 Regulations."

Unfair IR35 assessment
I was forced to do an IR35 assessment even though I was providing 1 week expert specialist consultancy! The HR department forced me to complete their own form.

Unfair IR35 assessment
Contract was deemed to be under IR35 so use of an umbrella was mandated.

IR35 fairly assessed
Division: BTS
I was told by the agency that the role is outside IR35, but I had to ask for reassurance. They did provide a CEST tool document showing how the decision was made.

Permanent roles only
Division: IT
Management using IR35 as an excuse to try & pressure contractors into accepting below market rates for FTC / Perm positions. Blanket policy, no individual assessments, very poor approach

The decision for contractors hasn’t been made and the company will announce its plans before the new tax year begins.
