Unfair IR35 assessment
If you are considering contracting via Capgemini, I recommend that you think really carefully and do a lot of due diligence. They treat contractors very poorly indeed, their administrative systems and services are burdensome and poor and they work hard to avoid paying. Experis are a complete nightmare as they have no understanding of IR35 regulations and their contracts are just a pile of poo. They often body shop to other companies and therefore you are worth nothing to them…and boy do they let you know it

I was contracting with a client, a large engineering consultancy. Initially, I was invoicing them directly. All was well. They then brought in AMS as an agency - despite introducing more admin, this was largely fine. I had two different IR35 assessments (one from QDOS and one from EY) that both declared me outside IR35. Later, in anticipation of the changes to IR35 regulations, the client engaged AMS to carry out IR35 assessments for all off-payroll workers. The assessment was suspect from the start, and AMS declared me (and everyone else, as far as I know) inside IR35. They then tried to push me towards their contractor umbrella partner, Giant. So, AMS, the company responsible for deciding whether or not I need the services of an umbrella company, also have a financial interest in referring me to a particular umbrella company. That smells strongly like a conflict of interest. Eventually, rather than walk away from the project, I grudgingly found a decent umbrella company (Contractor Umbrella) and signed up. My contract is about to expire, and the client has offered me an extension, but AMS now say I can only accept the extension if I move from CU to Giant or one of their other approved umbrella companies, many of which look very bad and unprofessional, some of which have even experienced recent security breaches. Conflict of interest, strong-arm tactics - most of my interactions with AMS have been dire.

Unfair IR35 assessment
2 months and counting with no pay. Questions answered on my behalf (is that legal??). Appeal submitted 4 weeks ago and no reply. Morson's do absolutely nothing to assist. Only plus side is im out of "official" contract so i can leave on the spot. Its getting very close to that point. I think this is very embarrassing for Motts. Extremely unprofessional.

Mott McDonald have used KPMG via Morson to do their determinations. Appears that the initial questionnaire sent out to contractors to fill in must have been discarded. Managers filling in the answers to the tool questions on what they think rather than reality. Left to the last minute with contract being cancelled before the appeals have been done (for what they are worth) and pushed into Champion Contractors (linked to Morsons?) Process looks to be done correctly but stage managed to give the risk free desired result for Mott McDonald. Lets see who is still there in 3 months time......

With an long term association with Capgemini as a contractor finally decided to leave. My contract was extended for more 6months but with inside ir35. I have known other companies who go via inside ir35 verification and let stay good and hard working conditions relationship. Also an individual can have a ir35 insurance to cover if there's any audit. Calgary HR should rethink there approach towards ir35 and help there colleagues stay.

Had determination done via kpmg tool which looks flawed and not fit for purpose. 3 external independent reviews previously carried out including cest all outside, yet kpmg puts me inside with incorrect answers to questions provided by management. Poor appeal process as no time left and contract cancelled. Forced into unregulated umbrella working, zero benefits zero rights zero hour contract, what could be better....

Blanket ban on consultants operating via Ltd/PSC company. No attempt made at SDS and all PSC contracts terminated. Managed to negotiate a an increase on the overall day rate for the inside IR35 engagement to part-compensate for the big decrease in overall take home salary.
