Umbrella only contractors

Outside IR35 banned
They are not engaging with PSC Ltd companies Umbrella only. Do not listen to what any agency tells you as it's not outside ir35. Working practices are rife with command and control. Contractors that do not fall in line with permanent style saluting are quickly shunted and treated poorly.

Went through several hundred CEST determinations. Even though CEST is highly questionable. This is process people should follow.

Fair assessments, excellent communication throughout. Senior leadership also took the time to speak to contractors and explain things. Transparent , reasonable and mature process throughout, benefitting both contractors and the business. Assessments issued in good time including detailed explanations and an appeals process. Good stuff all round.

Outside IR35 banned
Fanduel are following the blanket ban on PSCs, after initially indicating an Outside role, and are also not adjusting day rates to compensate. As a direct result they are having problems getting new contractors, and those that do sign up are leaving quickly.

They use Qdos. Contractor pays and fills out qdos questionnaire which client reviews and signs off. Contractor then provided with SDS deport. Clear communication throughout process and fast turnaround from offer to starting contract.

CEST and IR35 Shield used. Assessments conducted in collaboration with HR, Procurement, manager and contractor. Option to dispute if unhappy with outcome. SDS issued. Determined to be Outside IR35, happy with the approach

They have consulted HMRC to ensure answers to CEST are correct and so far all contractors are outside IR35

Contract deemed outside IR35, good rate, agency is on-top of IR35. Well done Camelot!

Fair assessment completed by Qdos, quite reasonably paid for by the contractor. Results discussed and approved with end client. Couldn't ask for better really.

Unfair IR35 assessment
Experis are the MSP - all PSCs must operate via them "Individual" CEST assessments, unfortunately using generic answers over the key areas. Completely ignored MOO, but have paid it lipservice by acknowledging CEST ignores this area so are siding with CEST. They have stated that in practice they would not accept substitutes, contradictory to contract wording. They have used generic answers regarding Control, stating they control how the work is done, what the working hours are, and the locations where the work is done. These 3 statements are simply not true. Very disappointed there have been no individual communications throughout the process. It would appear the risk averse approach has been taken. Individually assessed "enough" as to avoid criticism of blanket assessing, but by no means assessing each individuals exact working practices. I would expect many contractors to be terminating contracts over this

CEST Tool was used to provide individual determinations. Results shared with each individual with a request to check responses and provide feedback if we didn’t agree. 90% of contractors determined outside.
