Up until late 2020, they were using QUDOS who had determined most if not all outside IR35. All of a sudden big U-turn. “We are now using the CEST tool” we had long delays in getting a determination which was pretty much everyone inside IR35. Further delays getting our SDS to allow us to appeal (2 weeks before the end of March). It was clear they had incorrectly answered some key questions on the tool. When appeal came back they refused to changed the answers even when given evidence to support. Didn’t get the appeal back until a day after my contract had finished. Still inside they claim. I have walked away! Very disappointing. Any who have remained will be de-motivated to the max, and look for work elsewhere!

Initial CEST Determination on actual working practice showed Outside IR35, however this was asked to be changed by HR to show inside for the same reasons other contractors have mentioned in that apparently I am entitled to Benefits - even though I have evidenced that opted out as per my contract and that this is reported to GRi on a monthly basis. Also told that they would reject any substitute regardless of what is in my contract and that they force me to take out employers liability insurance for my employees who may be substituted! The reasoning given is that they wouldn't be able to access the systems and security requirements? The reasons given in the SDS are different to the CEST tool reasons that have been attached, clear that they are not reviewing these properly but just making any reason to stick by their view that everyone is inside based on the contract they have with GRi and nothing to do with individual contracts or working practices. The appeals process does not actually look at the evidence but states that they dont care what is in my contract, what an independent IR35 specialist reviewed the contract as but they "we stand by our assessment". Such a shame but i am leaving on that basis

So JLR have gone ahead and blanket assessed all PSCs as inside ir35 with their inaccurate SDS assessments. They have also set up a phoney appeals process where they simply reply *we stand by our assesment* without any evidence or explanation. Apparently as a contractor I am getting JLR benefits... but no explanation of course.. In previous years all JLR contracts included the right to substitute... in Dec 2020 they removed that right in preparation for their blanket approach. Interestingly they have had to ajust all their internal contract with TCS from T&M to Service contracts to keep themselves outside ir35... cute. So.. one rule for themselves and another for PSCs. All of course to avoid the 13.8% employers NI and the threat from hmrc. Goodbye JLR... Can somebody please challenge this in court... ?

Very similar SDS as last year using HMRC CEST tool. No longer will engage a limited company contractor after March. Interestingly also banned the use of umbrellas so if wanting to stay must go through PAYE with agent (but not all able to offer). Most contractors don’t seem to care and not even appealed, heads well in the sand.

Terminated almost all contractors on 1st April with four weeks notice, but agencies will only pay three weeks as a pre-advised shutdown week falls within the notice period.

Basically kicked the decision back to contractors. Would like to think they'll take a more considered approach to things if it comes in next year, but I don't have any faith that they will. I'll still be looking for something else in the next 12 months.

Previously issued blanket inside SDS (although claimed to be individual determinations). Asked all contractors a while ago to submit a result of a now out of date CEST tool. My agency would have requested that everyone go under an umbrella company. Lots of projects are impacted by contractors leaving. No real room for discussion or negotiations regarding the inside determination - for compensation you would have to formally request a pay-rise which comes with a number of restrictions. Now that the reform is delayed, PSCs are allowed again so contractors can make their own (potentially misguided) determinations.

Openly admitted "off the record" that blanket assessments were made originally but now they reverse the decision until next year. Many projects are now understaffed and failing as they panic to replace contractors that already walked.

Decision reversed, will continue to use contractors through PSCs. Appeal process has been abandoned, so results and/or evidence will NOT be communicated to contractors. Therefore there is no opportunity to make changes to contract terms or working practices that would result in the PSC and Refinitiv being in agreement about status. Any subsequent HMRC investigation could be influenced by the fact that the client has made an 'inside' determination that still stands. A grubby and disrespectful end to an appallingly mismanaged process, that leaves contractors exposed to risk.

Likely to be short term until next April 2021, hopefully JLR will carry out individual assessments before next year rather than blanket inside IR35 ruling previously carried out behind closed doors. It will be too late for many contractors who have already left or leaving this week with other contracts committed to. It has already impacted several critical model programmes
