Home Office running scared of HMRC

Outside IR35 banned
Division: Security
Despite a great deal of hard work to ensure contracts were outside IR35, halfway through the contract they were changed to inside with no real right of appeal. Roles hadn’t changed, just the threat of another fine from HMRC. The message was that so long as there is a Ltd company at the end of the payment chain then the role is inside IR35

Unfair IR35 assessment
Division: SADI
Home Office SADI team are recruiting for contractor service architects inside IR35 to work alongside existing contractor service architects who are on outside ir35 contracts. SADI are ramping down outside contracts at point of renewal whist bringing in new contractors inside IR35. This seems to completely contradict ‘the ruleset’ i.e. how can the same work / same resource pool be both inside and outside at the same time? This seems to be NOT “about fairness you see?” Agencies are also stating existing SC as a hard requirement - which I thought was not allowed.

Blanket assessment of all contractors not from the big consultancies as inside using the flawed CEST tool. Directly Informing HMRC of results for all contractors. Teams running the assessment are not even the hiring managers and just making up the assessments, then ignoring corrections from hiring managers. Appeal process also flawed. Very poor feedback on status from very unprofessional people. Refusing to explain why larger consultancies are not being found 'inside' despite identical hiring contracts (such as BLOOM and DOS). Projects going south. Mayhem and chaos.

Blanket role based assessment to Inside IR35. Completed in the middle of the contract with no information or appeal channel done with 10 working days notice. Take it or leave it offer - no uplift in rate.

Division: Biometrics
Contract assessed Using IR35 Shield by agent. Deemed outside. Moved on to SoW Deliverable model for last 2 extensions.

Outside IR35 banned
Contract cancelled and changed to inside with 4 days notice from agency. Blanket decision no individual assessment at all, not change of working conditions or rate.

Unfair IR35 assessment
Division: DDAT SADI
HMRC have embedded an IR35 advisor in HO who is currently working hard to overturn any CEST outside determinations. HO have announced that most contracts will be deemed inside going forwards (how do they know in advance?) and any outside determinations using CEST now have a follow up questionnaire for a manager to complete if contractors are assessed outside. All existing contractors are being reassessed at point of renewal. The followup questionnaire is about 20 questions and includes a ‘how long for?’ question if a substitute has been used and how much time is spent out of a 37 hour week working for alternative clients. Nothing about MOO of course. Obviously stacked to knock down any outside determinations. Atmosphere terrible. Contractors leaving and more are planning to.
