Blanket assessments via Brookson Legal, not directly relevant to the role. Very much a take it or leave it attitude from DXC. No options to discuss or assess fairly. Wasn't overly surprised as in many cases the Company treat contract staff very much like temps, rather than specialist expertise. Rolled off the role now.

No consultation with myself and the SDS mentions contract terms and clauses that don't match with mine. Appeal was given lip services and rejected. I'm forced to conclude that reasonable diligence and reasonable care have not been exercised when making the SDS, and it has not been done on an individual basis. I was provided with a “blanket” SDS, with only the name at the top having been changed to make it “my” SDS

Brookson Legal used, but whilst SDS were sent to individuals at different times, they have come out practically identical. All adjudged inside and all without any consultation with contractors. Work practices are biggest sticking point with no option to work together to change them and fall outside. Option now given to leave, accept or accept with a rate increase (assume will be determined on a case by case basis). Expect every contractor to ask for rate increase!

Brookson / AGS. No engagement with contractors. Assessment made against current contract terms. I believe the dtermination was delivered against me as an individual and not the role. I am engaged in one of two identical roles. I was deemed inside whilst the other contractor was deemed outside. In fact all contractors on the project were deemed outside most based on a reassessment of last years SDS being upheld. I was also deemed outside in the same role last year. I am the only SME to a technology which underpins a large number of business critical processes. The impact of my leaving cannot be understated in the short to medium term. I am the only one leaving. The others do not need to face that decision. The other contractors are confused and disappointed with the obvious disparity of the assessments for these two roles. I am obviously disappointed with the SDS but will not challenge it. I am not engaging with a process which cannot be impartial or engage with the process correctly.

IR35 u-turn made
Division: OCS
Previous review was deemed Null and avoid following what appeared to be blanket inside rulings. Difficulty now is to work with client and agency to ensure working practices and future contracts are worked towards a future outside judgement. Client have made no contact, and had to chase agency.

Received individual assessment as Inside but appears that assessment has been determined on parts of the contract that would be considered inside and ignoring parts of the contract that would make the determination Outside. Assumptions made about working practices that could be rebutted. Had already done own assessment with CEST and was outside, and confirmed that assessment by Brookson Legal has ignored the items that would be Outside. Appears that most others at DXC are in the same position. Challenges take upto 45 days to be assessed which would take it to near end of April from when assessment received, past the new implementation of IR35. Will not be extending on this contract.

Brookson Legal carried out assessment. Received SDS but all other contractors I know received the same thing. Many architects have left or are leaving. Engineers considering it. Looks like their new offer has them recovering costs for Employers NI and Apprenticeship Levy. Feeling Angry.

IR35 fairly assessed
It's been a painful process but have now finally been assessed outside IR35 at the second attempt. DXC have engaged Brookson Legal to perform contract and working practices assessments. First SDS I received said I was inside IR35 but yesterday I received a revised SDS stating I was outside IR35. They have left this very late though with some contractors having already left.

No SDS issued. No idea of what assessment process is being followed, if any. Was only asked if permanent role would be considered and at what salary, no other contact. Have left, many more contractors leaving. Am aware of contractors being offered extensions and new contracts but with no clear status determination which is nonsensical. Dxc has spent several years on Voluntary redundancies and a lot of knowledge is lost already. So already a bad atmosphere. Poorly planned, badly executed. Steer clear. Feeling angry but getting on with it.

Have yet to issue determinations on account roles as stalling until last minute. However, have been informed many times (verbally) that all roles on account will be inside IR35. Also told that there will be no scope for rate negotiations upwards to account for the increased cost of doing business ... if using PSC. Also applies if being engaged via PAYE as individual to offset increased taxes vs lower take home. DXC refusing any comms to agency on this despite many attempts and have breached request deadlines repeatedly. DXC confirm termination will be issued to capture end of current contract 31 Mar 20.

There has been no information from DXC to contractors or agencies as yet, however DXC have been actively rolling off contractors over the last 12 months. The take up of permanent roles have been slight and the offshore presence is growing.

No limited company contractors from April 2020. I was told that was a DXC group-wide decision not just the account I worked on, but I cannot be 100% certain of that.

Feedback I have received from several PMs suggest DXC are doing this right but are behind the curve. I am (perhaps optimistically - which isn't normally my position) getting the impression they will determine status correctly so genuine contractors will not be impacted. Time will tell. Tick tock.

Permanent roles only

Blanket treatment of no ltd company contractors accepted on the books from April. Divide and conquer approach with no group wide communication and instead taking individuals aside before scaremongering on options in the industry e.g. suggesting contracting in any form is now dead in the water and permie is the only way to go (umbrella and inside IR35 contracts not an option). Salary terms offered but at significantly reduced rate (and not offered to everyone). I have handed in my notice to take my chances in the open market but many have already transferred to permie (largely I think because of being uninformed on options and aforementioned scaremongering)
