Outside IR35 banned
Was informed that despite being initially determined as Outside IR35, the contract would only be renewed on an Inside IR35 basis despite no change in working practices being suggested (I worked remotely on tasks I determined in order to meet the clients goals). I asked about individual assessment and was told that "similar roles" had been assessed. I mentioned that each role and contractor is supposed to be assessed individually, and asked to see the SDS, I was told that one would be provided. It never arrived and I my contract was allowed to expire without renewal. Other contractors in the team experienced the same, if they declined to accept the Inside determination (as far as I know, SDS's were never provided) they were told they would not be retained. As a result, the entire project technical staff have left, to be replaced by inexperienced staff from a third-party outsourcing firm.

The Department has gone back on previous assurances and is handing down a blanket decision based on broad roles. They don't honour the CES Tool, but have not shown their own spreadsheet, or given reasons for this blanket decision. They cannot, or will not answer questions. The resignations are starting; often of the very best colleagues.

All existing/new contracts moving inside IR35 from 3rd Feb with no material change in working conditions (are DWP leaving themselves open). Agency say unaware of what's happening - No apparent discussions between parties

All the contracts are now cut short and if you want to stay, accept IR35 inside contract with the same rate, totally outrageous. Managers don’t know anything what happening. And contractors are getting a big hit here, feeling totally stuck.

Blanket decision has forced out over half the contractors and is already slowing major, 'critical' projects. I do not blame the DWP for this but the Government who have had ample opportunity to do this right but failed, despite court case after court case. My 30 years as a contractor (Java dev) are over and my skills are retiring abroad. If I am to be treated like an employee I shall do that in the sun and work from home.

Contract deemed inside. Appears to be a blanket decision on some critical projects. New contracts have no rate adjustments. Beware: Alexander Mann, abusing their position and in some cases cutting agencies out absorbing their cut and passing on worse terms.
