I used the HMRC online tool and the result showed that I was outside IR35 but my employer has found me to be inside. I will take a decision to work for a smaller company or freelance if these rules are implemented on 6th April 2020. I am not willing to do the same work for less pay and not have any of the benefits of being in a permanent contract. I think the people who make these rules have no idea about the increased pressure and risk to contractors in finding future contracts, taking responsibility for their own training and development, paying extra costs such as accountant fees etc and not being paid for annual or sick leave etc. All of this is ignored and we are heavily penalised without having a true understanding of the situation contractors face as HMRC are only focused on increasing the amount of tax they can collect. I am constantly looking for other opportunities that will keep me out of IR35 if the changes come into effect. This is a stressful and extremely difficult time for contractors made worse with the uncertainty around the new rules. For example what do they mean when they say the rules will be introduced with a soft landing or soft touch and they won’t be strict or heavy handed in implementing the changes the first year? I really think nothing has been clearly considered or communicated. It is a real shambles that is having an impact on the lives of many hard working self employed people.

As stated above outside IR35 for my engagement. I have a clearly written MSA in conjunction with a SOW. They clearly know their stuff and it’s refreshing to see a company approach this in the right way.
