Clydesdale Bank / Virgin Money previously confirmed that they would be assessing every contractor individually and carrying out a fair assessment. In reality, this could not be further from the truth. Every single contractor that I am aware of has been declared inside IR35. At the request of some agencies, team leads, who have no knowledge of IR35 whatsoever, were asked to complete a questionnaire, which was then used by the agencies to get a determination using CEST. There are various scenarios where experienced contractors are clearly working outside IR35, and the questionnaires clearly showed the contractors were outside IR35, but HR and the agencies returned the questionnaire to the team leads and asked them to change their answers in order to get an inside IR35 determination. Managed service providers, like Tek Systems and Waracle, have still not carried out any assessments. Despite this, all contractors at Tek Systems have been told they will definitely be declared inside IR35, and that if they're willing to go inside IR35, will be given a 12.5% cut on their day rate. Most experienced contractors are leaving to look for contracts outside IR35 or taking some time off. Some are open to taking contracts inside IR35 at other companies. Unbelievably, the bank have now declared a recruitment freeze, meaning that projects can't bring in anyone (perm, inside or outside) to replace all the contractors that are leaving.
