Brookson / AGS. No engagement with contractors. Assessment made against current contract terms. I believe the dtermination was delivered against me as an individual and not the role. I am engaged in one of two identical roles. I was deemed inside whilst the other contractor was deemed outside. In fact all contractors on the project were deemed outside most based on a reassessment of last years SDS being upheld. I was also deemed outside in the same role last year. I am the only SME to a technology which underpins a large number of business critical processes. The impact of my leaving cannot be understated in the short to medium term. I am the only one leaving. The others do not need to face that decision. The other contractors are confused and disappointed with the obvious disparity of the assessments for these two roles. I am obviously disappointed with the SDS but will not challenge it. I am not engaging with a process which cannot be impartial or engage with the process correctly.

To date, no formal announcement from HSBC regarding PSC. Unofficially, no U-turn on their blanket ban of PSCs which is leading to fury amongst their contractor community. Momentum is gathering for a contractor go slow, bill for 5 days but actually work for no more than 4 days each working week. The word is spreading.

Also seeing blanket bans across the market so highly unlikely that I am able to take on new clients. Feeling pretty depressed about the whole situation.

Blanked termination to INSIDE, the assessment was done, questions were asked, but no one cared about any details, nor asking me about practices nor my manager. My contract is truly outside and cannot be changed as so. Given this, it is just blank ban covered by the review from MBO to have an excuse they did 'reasonable care'.

Have yet to issue determinations on account roles as stalling until last minute. However, have been informed many times (verbally) that all roles on account will be inside IR35. Also told that there will be no scope for rate negotiations upwards to account for the increased cost of doing business ... if using PSC. Also applies if being engaged via PAYE as individual to offset increased taxes vs lower take home. DXC refusing any comms to agency on this despite many attempts and have breached request deadlines repeatedly. DXC confirm termination will be issued to capture end of current contract 31 Mar 20.

Clydesdale Bank / Virgin Money previously confirmed that they would be assessing every contractor individually and carrying out a fair assessment. In reality, this could not be further from the truth. Every single contractor that I am aware of has been declared inside IR35. At the request of some agencies, team leads, who have no knowledge of IR35 whatsoever, were asked to complete a questionnaire, which was then used by the agencies to get a determination using CEST. There are various scenarios where experienced contractors are clearly working outside IR35, and the questionnaires clearly showed the contractors were outside IR35, but HR and the agencies returned the questionnaire to the team leads and asked them to change their answers in order to get an inside IR35 determination. Managed service providers, like Tek Systems and Waracle, have still not carried out any assessments. Despite this, all contractors at Tek Systems have been told they will definitely be declared inside IR35, and that if they're willing to go inside IR35, will be given a 12.5% cut on their day rate. Most experienced contractors are leaving to look for contracts outside IR35 or taking some time off. Some are open to taking contracts inside IR35 at other companies. Unbelievably, the bank have now declared a recruitment freeze, meaning that projects can't bring in anyone (perm, inside or outside) to replace all the contractors that are leaving.
