Terrible experience

I am writing this to express my displeasure and frustrations with your service. I joined your company out of the choices that were presented to me by my agency but I have now come to regret this decision. Firstly, I was over-taxed because I requested to move from monthly frequency to weekly frequency. I have been short-paid for four weeks now and all efforts to get back this money have been frustrating for me. I have been on this matter for over three weeks now. Secondly, I do not receive any text message to notify me whether I will be paid or now. As of 5:31 pm today, Friday 13th of March 2022 I have not received payment and I have called your lines over four times today. I referred a colleague of mine to your company just because I believe the service will be beneficial mutually but I am wrong. I will be leaving this service as soon as possible.

Despite a great deal of hard work to ensure contracts were outside IR35, halfway through the contract they were changed to inside with no real right of appeal. Roles hadn’t changed, just the threat of another fine from HMRC. The message was that so long as there is a Ltd company at the end of the payment chain then the role is inside IR35

Oh look, a U-Turn! - If anyone has already received an SDS with an inside determination then choosing to remain is a dangerous card to play. Contracts appear to not be worth anything (based on how the determinations were performed) so a full review of how to continue needs to be carried out...otherwise its a self made trap that you're stepping in to.

Using KPMG tool, or so we are told as the assessments are yet to be done. It was supposed to happen this week now postponed with no ETA. No input from contractors, no negotiation on rates.

Using the KPMG tool but with no input from contractors. They have admitted that they are going down the "lower risk" route and just putting everyone inside, even people who are further outside IR35 than myself. They haven't yet issued any determinations, suspect they'll all be flawed anyway. Impact is already being felt but project managers (staff) continuing with previous dates with no accounting for the impact from next month. A complete disaster. They are trying to keep a number of contractors with unacceptable offers but I've found a new client that is engaging fairly so I'll be off.

Unfair IR35 assessment
Received individual assessment as Inside but appears that assessment has been determined on parts of the contract that would be considered inside and ignoring parts of the contract that would make the determination Outside. Assumptions made about working practices that could be rebutted. Had already done own assessment with CEST and was outside, and confirmed that assessment by Brookson Legal has ignored the items that would be Outside. Appears that most others at DXC are in the same position. Challenges take upto 45 days to be assessed which would take it to near end of April from when assessment received, past the new implementation of IR35. Will not be extending on this contract.

It's been a painful process but have now finally been assessed outside IR35 at the second attempt. DXC have engaged Brookson Legal to perform contract and working practices assessments. First SDS I received said I was inside IR35 but yesterday I received a revised SDS stating I was outside IR35. They have left this very late though with some contractors having already left.

CEST assessment delivered from corporate. At account level SDS’s started being received with no local or individual engagement to working practices, etc. Appears to be blanket assessment - same time stamp on several assessment Current engagement ends 31st March. Unsolicited assessment made on a role/extension I had not asked for, not been offered and not seen. Some contractors will leave, expect many will take inside. Perm jobs on offer for some individuals Projects could be impacted. Since SDS’s dropped atmosphere has dropped. Think this is about lack of engagement which locally had been reasonable Feeling hung out to dry and taken advantage off. Feel as though I am being treated like an agency worker not a business. Seems like they want agency workers... that’s what they’ll end up with.

Initially informed contractor workforce that there would be determinations and would be possible to appeal eg. if genuine freelance specialist. They have since reneged on this and all signs are a blanket ban contrary to spirit of legislation. They've wasted time and goodwill over preceding months.

Outside IR35 by exception only
1 2 1 talks or mass contractor meetings with management to inform them that they have been assessed as Inside. They are going on role and not the person and what they actually do. Internal job descriptions don't tie up well with a lot of contractor roles. Told they can appeal this decision but based on their perceived risk they seem to be firmly fixed on an "IN" determination. Management think a lot of contractors will stay but the area I work in will see the majority leave. Some are being offered the permie option however not all will get this. I will be leaving, not interested in permie. The risk factor due to all of this probably won't be released until after 6th April.
