IR35 u-turn made
Division: Technology
Postponed the changes until 2021. Too late for many who are still smarting after the way Morrisons treated everyone and will be gone way before next year.

Left to the last minute to provide us with pretty much a blanket ban. No SDS, no right of appeal, go umbrella or go home. Very disappointing.

We can’t quite work out if they lied or were just plain incompetent. After promising assessments for months it is now clear that they have not actually done any. Mass exodus promised from every single person I have spoken to.

“for services performed on and from 6 April 2020, Morrisons will only engage contractors working on a PAYE basis through an umbrella company or agency payroll (and not through a personal service company). Because those roles will not be “off-payroll” from that date, there will be no formal status determination statement” Fella actually made air quotes when mentioning the assessments they claimed to have done.

We were misled. Told that we would be individually assessed, but now a blanket ban on PSCs and only umbrella post March. Looks like a exodus of contractors with resignation letters being written as I type.

Despite promising individual assessments it has now been announced that Morrisons are terminating all PSC contracts before April and will be only engaging via umbrella from that point. I don’t imagine many will accept that.

Morrisons engaged KPMG (who themselves have a blanket approach to contractors, providing little confidence in a fair assessment). A decision was due by the end of Jan, this was delayed until Feb but was not communicated directly to Contractors leaving contractors apprehensive. Managers completed questionnaires stating they will adhere to working practices that ensure IR35 compliance, and contracts also indicate IR35 compliance. However, Morrisons management have ignored all of this and placed all contractors inside IR35. Many contractors have decided to leave which will delay projects - some of which are already overdue. At no point were contractors asked for input in to the determination. The atmosphere is exactly how you'd expect, contractors are dejected, unhappy, and feel unfairly treated. There is a feeling that Morrisons delayed the communication of the decision in order to try and corner contractors in to staying. This has been unsuccessful.
