Not sure where the fair assessments have come from In the last post but from what I have heard no one has been given a fair assessments and appeals have fallen on deaf ears

Sanderson Watts have adopted the underhand position of being able to offer an out of scope contract, however, they have reduced the rate offered such that it is marginally financially better than an in scope contract. SW may argue that "that is business", contractors collectively will see it as abuse of the marketplace and devaluing scarce and skilled resources. Contractors will not forget this and I hope that SW suffer as a result. This has further tarnished their already poor reputation amongst their supply chain.

Unfair IR35 assessment
Division: Nuclear decommissioning
It has been communicated that Cavendish Nuclear are preparing to shove all of their contractors on mass in scope AGAIN. The 12 month postponement was merely a delay to the inevitable. As expected, unfair assessments, frigged/incorrect answers to CEST determination questions to push you inside, no appeal process. Unfair & unprofessional. I hope all PSCs take note and get themselves fixed up elsewhere like I have. I predict a future struggle to attract resource to Cavendish Nuclear, and knock on project delivery difficulties - all of their own making!

Unfair IR35 assessment
Been given our SDS looks very much like a blanket assesesment as each contractor has the same answers on their CEST Test which was done by the engineering director after he determined every contractor had done it wrong in the first place. No co-operating with contractors at all, no professional external legal advice given even though one of their JV partners have classed their contractors as outside through external advice and not using the flawed HMRC CEST Test Very bad atmosphere and it has left every contractor felling like they have been bullied into the decision contractors looking to leave, if that happens no doubt projects will be effected

BP

Hugely disappointed by BPs decision and ultimatum to transfer to umbrella or leave. No assessments, no discussion, no exceptions. This goes against all the principles I thought BP held regarding fair treatment and respect to all, has definitely made me rethink how much of their beliefs are real or just for show.

Unfair IR35 assessment
Division: Nuclear
CEST Assessments are flawed as managers manipulated the answers to provide an inside determination (as instructed) and have said they will not accept any challenges ( just got mine back and I’m still inside, surprise, surprise), 100% blanket assessment. The project I am on is being impacted now as contractors are already leaving/retiring early. I am feeling very let down and I will be leaving ASAP.

We have been asked to complete the CEST tool And forward the results to HR but initial thoughts are they don’t believe in the results need to sit down with HR to discuss Maybe 3 options if inside, go staff, PAYE or leave but won’t know more until we get a final answer and we don’t know when that will be
