Surprising, but welcome, deferral by the Client, it took a week for them to decide / communicate. Hats off to the Agency for communicating as quickly as they did.

One of the few clients in the O&G industry to do things properly with Qdos. Now the reforms have been delayed, contractors deemed inside can now continue as Limited Company.

Fair assessment with Qdos. Process support with Fircroft. Outcome outside.

IR35 fairly assessed
Fair IR35 assessment carried out by Qdos. Had to pay for the service which is a pain but understood the reasons why. Uptake to start assessment could have been sooner but all in all happy considering other companies are taking a very different approach.

Unfair IR35 assessment
Division: Arup
Aircraft contract is watertight. Arup SDS is factually incorrect. Now being forced to sign a new contract with a new agency that is inside ir35.

Fairly assessed via QDOS with SDS supplied. Admittedly, charged for the privilege but end result was as expected.

Division: Projects
Qdos assessment for every contract Correct approach by client and agent to reach a genuine SDS for each supplier company Small fee for the questionnaire to be assessed by Qdos in preparation for the SDS which is a normal business expense and acceptable to my limited company

Unfair IR35 assessment
Division: Engineering
3rd Party Assessment (Qdos) for which PSC has to pay every 6months, no clarity on why PSC has to pay for their determination. SDS is pending on individual assessments submitted. Potential for Projects and PSC's to be impacted depending on determination outcome. Atmosphere is tense as the communication has been slow and unclear.

The impact of this blanket policy is wider than the reduced day rate, increased NI & tax contributions. I stand to lose significantly in terms of Company contributions to my pension, training & professional development needed to maintain professional memberships and registration with UK regulator for the services provided. It’s extremely disappointing that an arbitrary decision has been made about my status. I find myself demotivated and distracted by the amount of work I am having to undertake to obtain information from the Agency who are not very forthcoming.

Division: Project Planning
Blanket ban, forcing you down the route of PAYE with agency or FCSA approved umbrella. Even if you are outside IR35. Leaving contractors with massive tax bills, no company benefits, no chance of internal promotion, no stock plans, medical or anything else employees get here, not even free lunch. I am looking at winding up my small business after 15 years and going to work outside of the UK.
