Decision reversed, will continue to use contractors through PSCs. Appeal process has been abandoned, so results and/or evidence will NOT be communicated to contractors. Therefore there is no opportunity to make changes to contract terms or working practices that would result in the PSC and Refinitiv being in agreement about status. Any subsequent HMRC investigation could be influenced by the fact that the client has made an 'outside' determination that still stands. A grubby and disrespectful end to an appallingly mismanaged process, that leaves contractors exposed to risk.

Unfair IR35 assessment

Assessment was carried out by Ernst and Young with no discussion or involvement with the contractors and the Determination was only given out last week. SDS was claimed to be individually assessed, but seems to be a template letter with everyone being ruled inside on the basis of the same four items, which are inconsistent with contracts and day to day working. This programme of work will be massively impacted by this, as contractors vote with their feet to limit their financial loss and reduce the chance of prosecution by HMRC. Appeal process is a black hole with no feedback, no evidence and no timescales. Atmosphere is one of uncertainty, anger, stress and frustration. Three weeks from legislation that will put us out of business and we have no idea what is happening. Very surprised and disappointed that a people-focused company in this sector is making such a shambles of this process. They don't have control over the legislation, but they do have control over how it's implemented and this has been shockingly bad. Agency has been supportive but cannot influence the client's decision.
