No decision was made regarding IR35 until the week before contract expires on 26/03/20. Was a difficult and stressful thing chasing for update with the HR but it was worth the wait. A new contract outside IR35 was received on the same day HMRC announced deferral to next year

SDS provided by client x3 times outside IR35, Capita requested client to manipulate answers each time to try and manipulate the SDS to be inside. Luckily the IR35 2021 referral has come at the right time.

They used the CEST tool back in January and allowed us to choose some of the answers. Certain roles are all inside others roles appear to be all outside. Projects will be impacted, there's no doubt of that as I believe most contractors will leave who are deemed inside. The lack of communication from "above" within the company regarding this is astounding. As of 28th Feb contractos have not been told what will happen.

No PSCs allowed, blanket ban, must be PAYE through Capita or via umbrella from a PSL. Completed PwC questionnaire (for what it was worth - box ticking exercise only!) and received SDS today saying inside, even though I've had the very same contract & working practices independently reviewed and I've used the CEST tool, both of which confirm outside. Absolute rubbish!! Projects will be impacted and contractors are leaving. Everyone's been on tenderhooks. I feel like I've been backed into a corner with no reasonable options. I've been contracting for over 20 years and always paid my taxes. I'll be shutting down my company so no more VAT generation and collecting, no more Corporation Tax, no more PAYE or NICs (Ee or Er). Enough is enough!!!

Client is a PSBO and uses Role based CEST assessments, with predetermined outcomes. Proforma letter with individual name giving employment status provided on request. Hard to say if contractors are actively leaving, or being let go as part of a continuous 'role reduction process' which has significantly reduced contractor numbers. With most contractors seemingly over 50, many are considering early retirement. The general feeling is one of uncertainty and disproportionate unfairness that Labours' IR35 should even exist, let alone be made worse by the Cons. I feel resigned to suffer being trapped in this zero rights - high tax situation for a few years and retire.

Cest tool used by 'managers' to assess. 100% deemed to be inside IR35 by managers. Many contractors leaving. Some staying and taking inside despite their current 'outside' contract (as deemed by that contractor) being changed to inside IR35 and extended as such... I will be leaving.

Capita is giving complete disregard to already agreed terms of agreement which clearly allow for substitution, limited control and direction and substantial financial risk. SDS was provided WITHOUT the reason behind it. They are also unfairly advising the client based in half truths. In passing on the cost of employment to the contracts Capita is deducting Employers NIC at a flat rate of 13.8% and claiming it to be industry wide approach.

KCOM have decided to stop engaging PSC contractors, full stop. Existing contractors are being told they must re-engage through Capita Resourcing’s ‘Employed Resource Model’, under terms that are even worse than working inside IR35 or through an umbrella company. Nobody is accepting these offers, and projects are being cancelled as a result.

Although the terms of contract have specific clause to allow for substitution, given such a substitute satisfies the role’s skills, expertise requirement and meets other reasonable requirements and PSC bears the responsibility to pay such a substitute, the client and Capita seems to be ignoring this key aspect and saying the client has an ABSOLUTE right to reject a substitute

Capita have engaged PwC to do the assessments. Having done an assessment myself using IR35 Shield I was pretty shocked at the paltry number of questions that PwC think they need to ask in order to make an assessment, I honestly can't see how the questions they asked could qualify as due diligence.
