Given a Staus Determination of Outside and have been advised to continue as normal. Determination explained as to why this is the outcome and showed key areas where it stated why the piece of work would not be considered to be deemed employment. Determination by EY sounded quite detailed from the high level areas reviewed and statements were clear and considered. Results must be dependent on not the contract but working practices.

Can’t get more confusing assessment outcomes really. EY did the assessment and there is no pattern on why some are outside and why some are inside IR35 regulations. CEST clearly shows outside but EY tool gave mixed results with in the same team. Although SDS was given, I think assessment is totally flawed.

Getting so many different mixed messages. Assessments made by EY. Some hearing they are outside. Hearing that paye is going to be offered in April. People posting here that there is a blanket ban but not heard that internally. Not sure which way it will go.

AGS informs that WorldPay IR35 Project Team (HR) have not made their IR35 position known yet. Also said “it probably won’t be a blanket ban like other places have done, most likely individual assessments” ... but this doesn’t fill me with confidence this late in the day. People need to know, people need to decide if they want to continue with WorldPay or simply walk out come April. AGS have said if WorldPay’s decision is to make changes to current contract terms and conditions then the contracts will simply be updated come March-April. So a scenario could be outside until April 4th, then shift to inside on April 5th... (worst case) Contractors will be worried about being retrospectively investigates and any updates to a contract would require the contractor to agree/sign. else the contract should finish on April 4th or before if contractor does not accept. Notice periods would also not be applicable in this circumstances. AGS doing nothing but taking instruction from the client.
