Accepted a role here during height of pandemic. Day rate was quite poor and had to use one of four "recognised" umbrellas. There was no SDS and "policy" was contractors had to use "recognised" umbrella. Only took role as I hadn't worked for months and have never worked with such a collection of poorly skilled contractors (you truly do get what you pay for). Luckily found something else once market recovered and left contract early. Umbrella also messed up my timesheets and I was underpaid for weeks.

Part 4: Approx. 400 contractors on the verge of leaving or being replaced as risk of leaving is too high, atmosphere is as toxic as it was last year, feeling unsupported, rejected and powerless due to a cloak and dagger approach taken by what seems like jealous ill-informed hatters dictating their personal opinions in secret outside of regulation hidden behind an email address. Part 1: I received my determination three days before appeal required by E&Y. Incorrect answers used without any prior discussion as to my business affairs where they couldn't even get the notice period correct (reduced from 4 to 1 week). Manager not included in SDS but is aware I also work for others outside as well as my general working ethics and patterns. He also knows I have previously rejected other work/responsibility as I was not offered contract renegotiation which breached terms. Left both myself and manager anxious about future as he anticipates me leaving and needs replacement so I've as good as lost this work before I've even said or done anything.

Advantage Group passed along Initial assessment (using CEST), which was done months before I started by BAE without engagement with role sponsor - deemed Inside - when I started the role. Was told I could Appeal once. Undertook my own assessment using CEST tool, highlighting on multiple occasions that the answers put on the CEST tool were wrong & that the role was Outside IR35, backing this up with reference to the contract Ts&Cs I had signed up to through Advantage. Second assessment undertaken by BAE in conjunction with role sponsor, after they confirmed initially assessment was part of batch assessment done before the need for this particular role was even there. Answers came back that Ts&Cs in contract don’t count for anything & despite having only been in the role a few days, BAE believed the majority of their answers in the CEST tool still stood. Will therefore have to leave before project completes. Seems to be just a facade of reviewing, with vast majority of roles Inside.

360 degree u-turn in current unprecedented times, Business as usual contract renewed to continue under PSC outside IR35. SDS determination conducted are deemed null and void, further may need to re-baselining as per output from IR35 inquiry in House of Lords; cant be used against you according to advice from IPSE and QDOS, insurance covers the risk of litigation and liability claims.

HMRC CEST tool was used, This has been a blanket role based determination, which we recieved at the start of February. We have 45 days to appeal which i have. But with my contract up on the 5th April, i feel like i will be forced inside or nothing. It has caused a lot of consternation with the contractors and we are struggling to resources as it is.

Blanket decision, everyone put inside IR35, they are pretending to go through the assessment. Agree with other negative comments, judging by the positive ones, some people think it has been something it isn't. They should check independently. No one has been found outside and there is no appeal or discussion, not a genuine process and contracts are even being reworded with clauses removed to remove possiblilty of ever being found outside. Dozens leaving, most mid-programme.
